Beiträge zur Rechtsgeschichte Österreichs 16. Jahrgang Heft 1/2026, pp. 78-92, 2026/06/18
Zeitschrift der Kommission für Rechtsgeschichte Österreichs der Österreichischen Akademie der Wissenschaften
This paper provides an overview of Hans Kelsen’s activities as a Consultant for the short-lived US wartime agency, the Foreign Economic Administration (FEA), between 1944 and 1945. As the Allies intensified their post-war planning efforts from 1943 onward, particularly concerning the administ-ration and re-democratization of occupied territories, the FEA, like other US agencies, recruited emi-grant expertise.
Kelsen, a distinguished legal expert and author of the 1920 Austrian Constitution, was tasked with providing legal analysis and advice on Austrian and Central European matters, particularly concer-ning the re-establishment of economic and administrative controls. His work was closely integrated into the wider Allied planning for Civil Affairs (CA) – the relationship between the military and civilian population in occupied territories – which involved the Supreme Headquarters Allied Expeditionary Force (SHAEF) and the Office of Strategic Services (OSS).
